1. Introduction and Acceptance
These Terms of Service ("Terms") govern your use of the Booze mobile application (the "App") and the beverage delivery service (collectively, the "Service") operated by BOOZE DELIVERY d.o.o. for trade and services, with registered office at Sveta Marija 7C, 53291 Stara Novalja, Croatia, OIB: 99504289260, MBS: 040490243 (hereinafter: "we", "us", "our", or "Booze").
By creating an account, downloading the App, placing an order, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Definitions
- App — the Booze mobile application available on iOS and Android.
- Service — the beverage and goods home delivery service provided by Booze in the Novalja and Pag area.
- User or you — any person who downloads, registers for, or uses the App.
- Order — a request placed through the App for the delivery of products.
- Products — alcoholic and non-alcoholic beverages, tobacco products, ice, and other items available for order in the App.
- Delivery Area — the geographic zone in Novalja and Pag where the Service is currently available.
3. Eligibility (18+ Requirement)
The Service is intended exclusively for persons who are at least 18 years of age. By using the Service, you represent and warrant that:
- You are at least 18 years old;
- You have the legal capacity to enter into these Terms;
- You will not use the Service to obtain alcoholic or tobacco products for any person under the age of 18.
Pursuant to the Croatian Act on Restriction of the Sale of Alcoholic Beverages and the Tobacco and Tobacco Products Act, the sale and delivery of alcoholic beverages and tobacco products to persons under the age of 18 is strictly prohibited. We reserve the right to verify your age at any stage and to refuse or cancel any order if we have reason to believe this requirement is not satisfied.
4. Account Registration and Security
To use the Service, you must create an account by providing accurate and complete information, including your name, email address, phone number, delivery address, and date of birth. You are responsible for:
- Maintaining the confidentiality of your account credentials;
- All activity that occurs under your account;
- Notifying us immediately of any unauthorized use of your account.
We may suspend or terminate accounts that contain false information or that are used in breach of these Terms.
5. Use of the Service
You may use the Service only for lawful, personal, non-commercial purposes. You agree not to:
- Resell or redistribute products purchased through the Service;
- Use the Service to provide alcohol or tobacco to minors;
- Provide false age, identity, or address information;
- Use the Service in a manner that could damage, disable, or impair the App or its infrastructure;
- Attempt to gain unauthorized access to any part of the Service.
6. Orders, Pricing, and Payment
Pricing. All prices displayed in the App are in Euros (EUR), include applicable VAT (PDV), and may change without notice. The price applicable to your order is the price displayed at the time you confirm the order.
Order acceptance. Submission of an order constitutes an offer to purchase. A binding contract is formed only when we confirm acceptance of the order in the App. We reserve the right to refuse or cancel any order, in whole or in part, at our sole discretion (for example: product unavailability, suspected fraud, age verification issues, or delivery outside the Delivery Area).
Payment. Payments are processed by Stripe Payments Europe, Limited, a third-party payment processor. By placing an order, you authorize the charge of the total amount (including delivery fee, if applicable) to your selected payment method. We do not store your full card details; payment data is handled directly by Stripe in accordance with PCI DSS standards.
7. Delivery
Area. Delivery is currently available only within the Delivery Area (Novalja and Pag). Orders to addresses outside this area cannot be fulfilled.
Time. The estimated delivery time is approximately 30 minutes from order confirmation, but may vary based on demand, weather, traffic, and other factors. Estimated times are not binding deadlines.
Delivery fee. Any applicable delivery fee will be displayed in the App before you confirm the order.
Delivery attempts. If you are not available at the delivery address at the time of delivery and cannot be reached by phone within a reasonable time, the order may be cancelled. The product price (excluding delivery fee where required by law) may be refunded at our discretion, less reasonable costs.
8. Age Verification at Delivery
For any order containing alcoholic beverages or tobacco products, our delivery personnel are required by law to verify the age of the recipient using a valid government-issued photo identification document.
- The recipient must be at least 18 years of age and must present valid ID upon request;
- If the recipient cannot present valid ID, appears to be under the age of 18, or is visibly intoxicated, the delivery personnel will refuse to hand over the products;
- In the case of refused delivery for the reasons above, the order may be cancelled and the product price may not be refunded, in accordance with applicable law.
9. Right of Withdrawal and Returns
Pursuant to the Croatian Consumer Protection Act (Zakon o zaštiti potrošača) and Article 79 of EU Directive 2011/83/EU on Consumer Rights, the right of withdrawal does not apply to:
- Goods that are perishable or have a short shelf-life;
- Sealed goods that are not suitable for return for reasons of health protection or hygiene, if unsealed after delivery;
- Alcoholic beverages whose price has been agreed upon at the time of conclusion of the contract and the delivery of which can take place only after 30 days, where the price depends on fluctuations in the market.
If a delivered product is damaged, defective, or not as ordered, please contact us at support@booze.hr within 24 hours of delivery with photographic evidence. We will, at our discretion, replace the product, refund its price, or provide credit for a future order.
10. Prohibited Uses
In addition to the restrictions in Section 5, the following are strictly prohibited:
- Use of the Service in violation of any applicable law or regulation;
- Reverse engineering, decompiling, or disassembling the App;
- Automated access (bots, scrapers) without our prior written permission;
- Use that infringes intellectual property rights of Booze or third parties.
11. Intellectual Property
The App, the Service, the Booze name and logo, and all related content (text, graphics, design, software) are the intellectual property of BOOZE DELIVERY d.o.o. or its licensors and are protected by Croatian and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use, subject to these Terms. No other rights are granted.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
13. Limitation of Liability
To the fullest extent permitted by applicable law, BOOZE DELIVERY d.o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or relating to your use of the Service.
Our total aggregate liability arising from or relating to any single order shall not exceed the price actually paid by you for that order. Nothing in these Terms limits any liability that cannot lawfully be limited under Croatian law (including liability for death or personal injury caused by negligence, or for fraud).
14. Indemnification
You agree to indemnify and hold harmless BOOZE DELIVERY d.o.o., its directors, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
15. Termination
You may delete your account at any time as described on our Account Deletion page. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms or if we are required to do so by law.
Sections that by their nature should survive termination (including, without limitation, Sections 11–14, 16, 18 and 19) shall survive.
16. App Store and Platform Terms
These Terms are concluded solely between you and BOOZE DELIVERY d.o.o., and not with Apple Inc. or Google LLC. Apple and Google are not parties to these Terms and are not responsible for the App or its content.
To the extent you obtained the App from the Apple App Store, you acknowledge and agree that:
- These Terms are between you and us only, not with Apple; we, not Apple, are solely responsible for the App and its content;
- Apple has no obligation to furnish any maintenance or support services for the App;
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund any applicable purchase price; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App;
- Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory non-compliance, or consumer protection claims;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
You also agree to comply with all applicable third-party platform terms (for example, the Apple Media Services Terms and the Google Play Terms of Service) when using the App.
17. Changes to These Terms
We may modify these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Material changes will be notified to you through the App or by email at least 14 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Croatia, without regard to conflict-of-law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Republic of Croatia. Consumers domiciled in the European Union may also access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
